1. Acceptance of Terms
By downloading, installing, or using Vialr (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
2. Important Medical Disclaimer
Vialr is a tracking and organizational tool only. It does not provide medical advice, diagnosis, or treatment.
- The app is not a substitute for professional medical judgment.
- Always consult a licensed healthcare professional before making medical decisions.
- In an emergency, contact local emergency services immediately.
3. Eligibility
You must be at least the age of majority in your jurisdiction (or have valid parental/guardian consent where permitted) to use the app.
4. Accounts and Access
The app may be used without creating an online account. You are responsible for maintaining control of your device and access credentials.
5. Data Handling Model (Local-First)
Vialr is designed as a local-first app.
- Your tracking entries are stored on your device.
- We do not provide a user cloud backend that stores your health entries by default.
- If you export/share data, that action is initiated by you.
6. Subscription and Billing
Some features may require a paid subscription.
- Subscriptions are billed through Apple App Store and governed by Apple's billing terms.
- Auto-renewal, cancellation, and refunds are managed in your Apple ID settings.
- We do not directly process your payment card details.
7. Permitted Use
You agree to use the app only for lawful purposes and in compliance with these Terms. You will not:
- Use the app to violate laws or regulations
- Attempt to reverse engineer, interfere with, or disrupt the app
- Misrepresent data in ways that could cause harm
8. Health Data and User Content
You may enter personal health-related information in the app. You retain ownership of your data.
Because we do not host your entries on our own user-data backend by default, your data remains on your device unless you export/share it or explicitly use third-party features.
9. Apple Health / HealthKit
If enabled by you, the app may read/write certain HealthKit data with your explicit iOS permission. Your use of HealthKit features is also subject to Apple's terms and policies.
10. Intellectual Property
The app, including code, design, branding, and content (excluding your data), is owned by Vialr and protected by applicable intellectual property laws.
11. Third-Party Services
The app may rely on third-party platforms (for example, Apple App Store, StoreKit, HealthKit). Third-party services may process data under their own terms and privacy policies. We are not responsible for third-party services, policies, or outages.
12. Availability and Changes
We may modify, suspend, or discontinue all or part of the app at any time. We may also update these Terms by posting a revised version with a new effective date.
13. Termination
We may suspend or terminate access if you violate these Terms or use the app in harmful or unlawful ways.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, express or implied.
15. Limitation of Liability
To the fullest extent permitted by law, Vialr is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising from your use of the app.
16. Indemnification
You agree to indemnify and hold harmless Vialr from claims, liabilities, damages, and expenses arising out of your misuse of the app or violation of these Terms.
17. Governing Law
These Terms are governed by the laws of the jurisdiction where Vialr is established, without regard to conflict of laws principles.
