End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Vialr governing your use of the Vialr mobile application ("App"). By installing or using the App, you agree to be bound by this EULA.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, subject to this EULA and the Apple Media Services Terms and Conditions.
2. Scope of License
This license does not allow you to:
- Distribute, sublicense, lease, rent, or lend the App to third parties.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Copy, modify, or create derivative works based on the App.
- Remove, alter, or obscure any copyright, trademark, or proprietary notices.
- Use the App for any unlawful purpose or in violation of applicable laws.
3. Data and Privacy
Vialr is a local-first app. Your health tracking data is stored on your device and is not transmitted to our servers. For full details, see our Privacy Policy.
4. HealthKit Integration
If you choose to enable Apple HealthKit integration, the App may read and/or write authorized health data with your explicit iOS permission. HealthKit data is never used for advertising or data mining. Your use of HealthKit is also subject to Apple's terms.
5. Subscriptions and In-App Purchases
Some features may require a paid subscription or in-app purchase.
- All payments are processed through the Apple App Store and are governed by Apple's billing terms.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple ID settings.
- We do not directly collect or process your payment information.
6. Medical Disclaimer
The App is a tracking and organizational tool only. It does not provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical judgment. Always consult a licensed healthcare professional before making medical decisions.
7. Intellectual Property
All rights, title, and interest in the App — including but not limited to code, design, graphics, logos, and trademarks — are owned by Vialr and protected by applicable intellectual property laws. This EULA does not transfer any ownership rights to you.
8. Third-Party Services
The App may rely on third-party services (e.g., Apple App Store, StoreKit, HealthKit). These services are governed by their own terms and privacy policies. We are not responsible for third-party services, outages, or policies.
9. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Vialr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the App.
11. Indemnification
You agree to indemnify and hold harmless Vialr from any claims, liabilities, damages, losses, and expenses arising out of your use or misuse of the App or violation of this EULA.
12. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
13. Updates and Modifications
We may update or modify the App at any time. We may also update this EULA by posting a revised version with a new effective date. Continued use of the App after changes constitutes acceptance of the updated EULA.
14. Apple-Specific Terms
This EULA is between you and Vialr only, not with Apple. Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App, Apple is not responsible for any product warranties. Apple is not responsible for addressing any claims relating to the App or your use of it. Apple is a third-party beneficiary of this EULA with the right to enforce it against you.
15. Governing Law
This EULA is governed by the laws of the jurisdiction where Vialr is established, without regard to conflict of laws principles.
